Overview

GreenSky is seeking Product Counsel—Servicing to provide legal support for the innovative online lending solutions that GreenSky administers.  We seek to empower both consumers and businesses by facilitating frictionless access to consumer financial products, and we are looking for creative attorneys to support that mission while maintaining compliance with applicable consumer finance regulations.   This role will advise the company on laws and regulations applicable to the servicing and collections of consumer loans, with a particular focus on consumer protection, fair lending, UDAAP, and other federal and state regulations. 

 

As Product Counsel—Servicing, the successful candidate will engage with and provide legal advice to multiple stakeholders on the servicing and collections of our program’s consumer lending products.  Particular focus will be paid to transactions, billing, payments, credit reporting, disputes, and collections of the products we administer, including a card accessed, closed end credit product.  Your expertise and guidance will ensure that we are servicing consumers in a manner compliant with applicable laws and regulations. 


Organizational: This position is a member of the Legal Department, reporting to GreenSky’s Senior Regulatory Counsel.

Duties & Responsibilities

  • Provide legal guidance on the servicing and collections of consumer loans, including with respect to billing, payments, credit reporting and complaint/dispute resolution.
  • Advise the business on regulatory requirements arising from relevant laws such as Truth in Lending Act (Reg Z), Fair Credit Reporting Act (Reg V), Reg E/NACHA, the Bankruptcy Code, debt collection statutes, and UDAAP.
  • Stay current on changes in laws and regulations related to online lending and fintech, providing regular updates to leadership and advising on the impact of these changes to product strategy.
  • Work closely with compliance teams to develop internal policies and procedures to ensure ongoing compliance with applicable laws.
  • Participate in regulatory examinations and audits, preparing responses and representing the company as needed.
  • Provide legal advice on and support other consumer finance regulatory initiatives that may arise from time to time.

 

Required Skills/Qualifications

  • 5+ years of legal experience in financial services and consumer credit, with a particular focus on servicing and collections of unsecured consumer loans and applicable laws including the laws identified above. Ideal candidate will have experience working for a large law firm or financial services company, as well as familiarity with closed-end loan products (including card-accessed loan products).
  • Juris Doctor from a highly regarded American law school; admitted to practice law in the relevant jurisdiction based on location or as required by applicable bar rules.
  • Deep knowledge of applicable federal and state consumer lending laws and regulations.
  • Must be self-directed, organized, positive, driven, detail-oriented, and effective in a fast-paced, changing environment.
  • Ability to quickly grasp new complex concepts and regulations.
  • Ability to work independently and be team-oriented.
  • Strong work ethic.
  • Ability to assess, balance and mitigate risk and actively engage with various internal stakeholders to responsively address business and enterprise considerations
  • Ability to work effectively in a fast paced, high-tempo work environment
  • Capacity to collaborate across different teams effectively within a high growth, dynamic organizational environment
